TAKE NOTICE of the holding of a public meeting for the purpose of informing the public and hearing representation in respect of a proposed by-law to refresh the Town’s Commercial and Industrial zoning categories of the Comprehensive Zoning By-law 27-2006, in keeping with the policies of the County of Hastings Official Plan.

AND TAKE NOTICE THAT this is a Town-initiated application. A report and draft zoning by-law amendment has been prepared to explain the purpose and effect of the amendment and illustrate properties throughout the Town that are directly affected by the proposed zoning by-law amendment.

AND TAKE NOTICE THAT Council will hold a public meeting on the 26th day of June 2024, at the hour of 2:00 pm for the purpose of informing the public in respect of the proposed by-law and to give the public an opportunity to make representation in respect of the proposed by-law.

AND FURTHER TAKE NOTICE that if a person or public body would otherwise have an ability to appeal the decision of the Municipal Council for the Town of Bancroft to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Bancroft before the by-law is passed, the person or public body is not entitled to appeal the decision.

AND FURTHER THAT if a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Council for the Town of Bancroft before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.


PURPOSE AND EFFECT:

The Town is required to bring the Comprehensive Zoning By-law into compliance with the County Official Plan. The Town is doing so on an incremental basis, beginning with the Commercial and Industrial zoning categories. This priority was established by the Town’s Economic Development Strategic Plan.

• The proposed amendment affects all properties throughout the municipality with a commercial or industrial zone. The amendment also affects the properties designated Future Development in the Official Plan. Some properties currently zoned for commercial or industrial purposes that are not recognized for such purposes in the Official Plan are proposed to be rezoned similar to the surrounding properties.

• The 4 existing commercial zone categories have been retained. The permitted uses for all four zones have been modernized and the Local Commercial zone category has been adjusted to ensure that the permitted uses are more appropriate for application in neighbourhood settings.

• The 4 existing industrial zone categories have been retained but the list of permitted uses have generally been expanded to promote investment. Three new industrial zones have been created to address unique requirements – an Urban Employment zone as directed by the Official Plan, an
Airport Industrial zone to introduce non-aviation uses on the airport property, and a Rural Industrial zone to recognize that the Town has a large rural land base with unique employment opportunities.

• All zone categories have been assigned regulatory flexibility, where appropriate, to acknowledge full municipal, partial municipal, or full private services options.

• The proposed amendment introduces a new zoning category “Future Development” in accordance with Official Plan policy to reflect that not all property within the Bancroft Urban Community is appropriate for urban scale development at this time.

• Finally, the proposed amendment adds new definitions for newly introduced permitted uses and several house-keeping amendments that arise either due to the scope of the amendment or to facilitate efficient administration of the by-law.

ORAL AND WRITTEN SUBMISSIONS:

Input on then proposed zoning by-law amendment is welcome and encouraged. You may provide input by speaking at the Public Meeting or by making a written submission to the Town of Bancroft. To provide input in writing please send correspondence to the Clerk at the e-mail or mailing address provided below by 12:00 p.m. (noon) on June 19, 2024.

If you wish to be notified of the decision of the Municipal Council for the Town of Bancroft on the proposed zoning by-law amendment, you must make a written request to the Clerk at the address below. Please include your name, mailing address and telephone number in any correspondence.

OPEN HOUSE:

Prior to the holding of the formal Public Meeting, the Town is holding an Open House to give the public an opportunity to review and seek information about the proposed amendment. Municipal staff will be in attendance to respond to questions and make a record of any comments offered.
Additional information related to the proposed Zoning By-law Amendment is available for review at the Town of Bancroft Municipal Offices, Monday to Friday, during business hours. A copy of the Staff Report, draft zoning by-law amendment, including map schedules can be viewed on the Town’s web site at bancroft.ca.

NOTICE OF COLLECTION:

Personal information collected as a result of the Public Meeting and Open House is collected under the authority of the Municipal Act, the Municipal Freedom of Information and Protection of Privacy Act, the Planning Act, and all other relevant legislation, and will be used to assist in making a decision on this matter. Questions regarding the collection, use, and distribution of the personal information may be directed to the Clerk.
